These Terms of Service govern your access to and use of Markt, operated by Markt ("we," "us," or "our"). By using Markt, you agree to be bound by these terms. Please read them carefully.
By creating an account or accessing Markt in any way, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be legally bound by them. If you are using Markt on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
We may update these Terms at any time. Continued use of the service after changes are posted constitutes your acceptance of the revised Terms.
Markt is a market intelligence platform that provides product analysis, trend data, ad saturation metrics, and composite market scores to assist e-commerce sellers and developers in evaluating product opportunities.
Paid plan subscribers receive access to the Markt REST API. API usage is subject to the rate limits and request quotas associated with your plan tier. API keys are personal and must not be shared or exposed publicly.
Markt aggregates data from third-party sources including shopping APIs and trend services. We make no guarantees regarding the accuracy, completeness, or timeliness of any data or scores. All outputs are informational only and do not constitute financial or business advice.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at marktcustomerservice@gmail.com if you suspect any unauthorised use.
We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in any activity that harms Markt or its users.
Markt offers Free, Standard ($29/mo), Pro ($79/mo), and Enterprise ($299/mo) plans. Each plan includes a defined monthly analysis quota. Unused analyses do not roll over to the next month.
Paid subscriptions are billed monthly in advance via Stripe. All fees are in USD and are non-refundable except as required by applicable law or at our sole discretion.
If you exceed your monthly quota, additional analyses will be blocked until your quota resets or you upgrade your plan. We do not charge automatic overage fees without your prior consent.
You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. You retain access to paid features until that date.

All content, software, algorithms, scores, and interfaces comprising Markt are owned by us or our licensors and are protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand elements.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use Markt solely for your internal business purposes.
Markt integrates with third-party data providers including Google Trends and shopping APIs. We are not responsible for the availability, accuracy, or terms of these third-party services. Your use of outputs derived from third-party data is at your own risk.
MARKT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, MARKT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNTS PAID BY YOU TO MARKT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Markt and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the service, your violation of these Terms, or your infringement of any third-party rights.
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction.
